RIGHT OF WITHDRAWAL
1. General
2S STORE O.E., with Tax Identification Number (AFM) 803175317, competent Tax Office KEFODE ATTIKIS, General Commercial Registry (G.E.MI.) number 191346501000, and registered office at 12 Fokionos Street, Athens, 105 63, through the Hot Spot online store (https://www.hot-spot.gr/), respects and upholds the consumer rights provided for under the applicable Greek and European legislation on distance contracts.
Under the applicable legislation, the consumer has the right, subject to the conditions laid down by law, to withdraw from a contract concluded through the online store without giving any reason and without incurring any charges other than those provided for by law.
2. Withdrawal period
The consumer has the right to withdraw from the purchase within fourteen (14) calendar days from the day on which the consumer or a third party designated by the consumer, other than the carrier, acquires physical possession of the product.
In the case of an order for multiple products delivered separately, the period begins on the day on which the consumer acquires physical possession of the last product.
Exercising the right of withdrawal does not require giving any reason.
3. How to exercise the right of withdrawal
To exercise the right of withdrawal, the consumer must inform 2S STORE O.E. of their decision before the expiry of the above period.
Notification may be made by an unequivocal statement sent by email to:
or by any other means that allows the withdrawal statement to be demonstrably communicated to the business.
For faster service, it is recommended that the message include:
- the customer’s full name,
- the order number,
- the order date,
- the products to which the withdrawal relates,
- contact details,
- how the customer wishes the return to be carried out.
The consumer may also use the following indicative statement:
“I hereby notify you that I withdraw from the sales contract for the following products under order number __________, which was placed on __________ and delivered on __________.”
Use of a specific form is not mandatory, provided that the communication clearly indicates the consumer’s decision to withdraw.
4. Return of products
After informing 2S STORE O.E. that they are exercising the right of withdrawal, the consumer must return the products without undue delay and, in any event, within fourteen (14) calendar days from the day on which they communicated their decision to withdraw.
The deadline is deemed to have been met if the consumer dispatches the products before the expiry of the fourteen (14) days.
The products must be returned in a manner that allows their safe transport and, where possible, together with their packaging, accessories and accompanying items.
The consumer is liable for any diminution in the value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
5. Return costs
Where the statutory right of withdrawal is exercised, the consumer bears the direct cost of returning the products, unless 2S STORE O.E. has agreed otherwise or the applicable legislation provides otherwise.
The initial shipping cost paid by the consumer is refunded in accordance with the provisions of the applicable legislation.
If the consumer chose a delivery method for the original order that was more expensive than the least expensive standard delivery method available, the additional charge arising from that choice is not refunded.
6. Refunds
Where the right of withdrawal is validly exercised, 2S STORE O.E. refunds the consumer the amounts paid for the purchase, including, where required, the initial delivery costs.
The refund is made without undue delay and in accordance with the time limits provided for by the applicable legislation.
2S STORE O.E. reserves the right to withhold the refund until it has received the returned products or until the consumer provides evidence of having sent them back, whichever occurs first.
As a rule, the refund is made using the same means of payment as that used for the initial transaction, unless otherwise agreed with the consumer.
7. Special provision for personal-use and hygiene products
Due to the nature of certain products offered by Hot Spot, the special legal provisions concerning products which, for reasons of health protection or hygiene, are not suitable for return after being unsealed apply.
In particular, the right of withdrawal does not apply to sealed products which are not suitable for return for reasons of health protection or hygiene and which were unsealed after delivery, in accordance with the exception provided for by law.
This exception applies only where the statutory conditions are met and does not automatically cover every product offered by the online store.
By way of example, the business may apply the above exception to personal-use products, products that come into direct contact with the body, or products whose sealed packaging is a prerequisite for protecting their hygiene, where such products have been unsealed after delivery.
For this reason, the consumer must not unseal products whose packaging bears a relevant indication or seal if they wish to retain the right of withdrawal.
The existence of this exception does not affect the consumer’s statutory rights in the event of a defective, malfunctioning or incorrectly dispatched product.
8. Underwear and clothing products
For clothing and underwear products, the consumer must handle them with the necessary care during the withdrawal period.
Trying on a garment must be done in a manner comparable to what would be possible in a physical store, without use or handling beyond what is necessary to establish the product’s size, fit, nature and characteristics.
Returned products must be clean, in suitable condition and, where feasible, with their original packaging and relevant labels and accessories.
If a particular product falls within the exception provided for by law for health or hygiene reasons, the relevant provisions of the preceding section apply.
9. Defective or incorrect products
The right of withdrawal is distinct from the consumer’s statutory rights in the event of a defective product, a product that does not conform to the order, or a product dispatched in error.
If the consumer receives a product that is defective, does not match their order or has been sent in error, they are requested to contact 2S STORE O.E. immediately at info@hot-spot.gr or +30 693 401 5464 so that the matter can be examined and the rights provided for under the applicable legislation can be applied.
10. Discretion in returns
2S STORE O.E. acknowledges the particular nature of certain products offered through Hot Spot and handles returns and related communications with absolute discretion.
Order details and any communications concerning a return or withdrawal are handled in accordance with the business’s Privacy Policy and applicable personal data protection legislation.
